Billing Rates and Costs

Attorney ethics rules govern how attorneys can charge legal fees. Essentially there are three ways for an attorney to charge for their legal services: hourly, flat fee, or contingency fee, which is usually reserved for Accident/Injury/Liability/Negligence types of cases.  Outside of the Accident/Liability cases, our office usually handles most cases using "Flat-Fee" pricing.  While some actions may seem routine, each case is fact specific and only after a thorough consultation can we determine a fair and appropriate fee for legal representation in any given case. We offer free consultation by phone, for your initial consultation.

When an attorney with Dan Whitehead Law Offices consults with you, they will discuss with you the precise fees for whatever services your case requires. Although some lawyers provide “one size fits all” or generic pricing, we know that it is in our client’s best interest to take the time to make an expert determination of the time commitments and associated legal fees that may be appropriate for each client’s specific case. The fact is that every case is different, and although two clients may face similar charges, each client might require a different defense. For example, one client may be looking for a plea bargain or a dismissal, and another client’s case may need to go to trial are require motions to suppress evidence.

Some cases are like ice bergs – they look small and innocent on top but once you get close you enough you realize  the full magnitude of the issues in question.  There may come a time that we will need to reevaluate your situation  because of new challenges that present themselves during the progression of your case. For example, a case may start as just a simple divorce but two months into the case, there are  grandparents seeking visitation rights and DCS has been called out to interview your children.  These complications can add a great deal of complexity, time, and research to your case.  We will discuss the possibilities of what may happen during your consultation.


The price you are quoted for your case is for legal representation only.  Filing fees or other court fees, and other incidental expenses including, but not limited to transportation/mileage costs, document procurement,  investigations, etc. are not included in a Flat-Fee quote, and will be discussed as case needs dictate.
